My opinion on derivative suits including Mamadou and Hamrick/Martineau

I wish Mamadou had returned my calls over the last year. Apparently he didn't understand NV law and now court said he is losing standing. His ship is sinking. OUR ship. His case is OUR case. OUR discovery. I'm very sad and disappointed.

Many are asking what’s going on, so I’m saying it plainly:

All these derivative cases are OURS:

-Mamadou Coulibaly’s case active
-Hamrick’s intervention (opposing Liqueous) active
-Hamrick/Martineau case (against hedge funds + board) active
-Vick/Muntz/Genis (NV) dismissed "without prejudice"
-Vick vs Hudson Bay (SDNY) "without prejudice"

They’re all derivative.

That means filed on behalf of the company, and therefore on behalf of all shareholders.

If a shareholder makes a mistake in these suits, it hurts us all. That’s why good counsel is critical, and not all are equal. Some attorneys care, others don’t.

I’ve always supported Mamadou’s case. But unfortunately he hasn’t been a team player. He declined my help, legal, financial, strategic.

I’ve gained real experience over 3 years: fundraising, litigation, DOJ, SEC, SDNY, NV. When he told me why he filed solo, I accepted it. I didn’t attack him. But now he and others are pointing fingers at these new guys? That’s wild. I support them as I support Mamadou. They are our chance at actually funding our company. Read their complaint.

They are going after board AND Hedge funds. Mamadou is not.

It's not a copy of my case as some said. You are sounding like the defense. Remember the defense accused Mamadou of copying my case? Well it wasn't entirely true but he had to defend it - why give them fodder against they new guys.

Your enemies are those that stole from you. NOT those trying to get money back spending money on attorneys and going to court. Think logically folks!!!!

Bad actors are not shareholders. I won’t name names here, but many of you have heard my strategy privately. I’ve tried to collaborate. If people won’t pick up the phone, throw away legal groundwork, and spread misinformation, then I have to press on alone.

The tweets like “isn’t it interesting…” are junk. Misquotes, twisting context, and lazy innuendo. Listen to the actual audio. Understand what “dismissed with prejudice” vs “without” means. Words matter.

Real shareholders, Hamrick, Martineau, Coulibaly, Muntz, Genis, me, we signed our names. We filed in court. We filed evidence. Over 2,500 others signed under penalty of perjury to support Nevada and SDNY actions.

Focus on the prize. For me, it’s:

Accountability: Civil + criminal. Jail time, SEC fines, restitution.

Money: I want my money back. There’s still a path, but infighting and careless moves hurt us all.

There are I think 14+ cases I’m tracking: some dismissed, some settled, some ongoing. They’re public. Do your own DD. I have. Those of us who filed have lost hundreds of thousands like many of you. That’s proof of intent. Meanwhile, Twitter calls with 25 people on Tuesdays? That’s not "the" community. It's "one of" the communities. It's a great one but does not mean your in or not if you don't attend. Why go online to debate people that hate you? I found it unproductive. Thousands of retail holders support the lawsuit efforts and aren’t even online.

Those who have reached out with apologies - I gladly accept. We all get involved in emotion. No worries - the past is the past. Those actively involved in disparaging, criticizing, etc. - show the facts. Don't make stuff up. Those listening call it out - read the proof - you'll find there isn't any.

Stop handing ammo to the defense. If you can’t work with the SEC, DOJ, or fellow shareholders, at least don’t sabotage those shareholders. Speak in private. Ask questions in private.

Updates hopefully coming. I read the filings as they come in just like you. But we're in a waiting cycle right now.
